Tax Implications on Estate and Trust Beneficiaries

Tax Implications on Estate and Trust Beneficiaries:
Analyze the clients’ estate and determine tax implications on estate and trust beneficiaries.

Bob and Betty Fisher will have a tax exemption resulting in them not paying any taxes with a few changes to their estate plan. The only transactions that will need to be catered to are the probate and funeral costs, alongside other debts. There will be other tax ramifications, especially to the beneficiaries, given the recent changes to the estate plan. Since the Dali painting will be deemed a gift by the time it’s being passed to his sister, no tax will be assigned to the transfer.
The use of bequests and gifts would help Bob significantly reduce the amount of taxes paid by the beneficiaries of the act (Mayer, Warner, & Siedel, 2012). Concerning the beneficiaries and specific amounts they receive; Bob cites that the estate will be divided equally among them. Once an education fund is set for Betty’s daughter and an amount set aside for them, each of the three siblings is expected to get approximately $2,081,925.
Using a testamentary trust, the tax ramifications significantly depend on whether the settlor dies before the decedents. However, if the settlor dies first and there is no clause outlining the division of the estate, the trust reverts to the settler. If the decedent’s death, they are often taxed the estate’s value on a specific date. This disadvantage is one of the most significant associated with these types of trusts. As such, an irrevocable trust is advisable as it prevents the estate from being eaten up by taxes. Another strategy Bob and Betty could use is to use gifts to family members to reduce the taxable amount of the estate.
IV. Marital/Property Transfers:
Bob will have to include Betty as a beneficiary to significantly reduce the estate’s tax requirements as it will be subject to a marital deduction. This deduction also consists of the mortgages. Since Betty will also have to take care of her daughter and earn some income on the side, it is recommended that Bob leaves her the personal property, vacation home and personal residence. Bob can also leave her the cash account to provide for her daughter’s education.
To satisfy all the identified requirements, Bob should set up an irrevocable trust. This trust will save on costs concerning taxes and allow more control for Bob concerning how the estate is divided up among the beneficiaries (Miller, 2017). The trust will also reduce the likelihood of probate and the costs associated with the process.
Placing the property in a qualified personal resident trust might remove the property from the estate thereby averting estate tax (Mayer et al., 2012). Furthermore, Betty might be allowed to continue living at the property for a predetermined period. On the other hand, depending on how the trust is set up, Betty might be required to outlive the term of the trust to realize trust savings if she is allowed to live there. This action would also cause the value of the property to be adjusted depending on the amount of time she spends there (Mayer et al., 2012).
