Discussion of Cases: Each week the class will share responsibility for the online discussion of the cases. Each class period will have several cases to review in advance(usually the week before). ALL CASE DISCUSSIONS ARE DUE THE WEEK THAT THE CASE IS COVERED –NO EXCEPTIONS. THEY ARE DUE ON THE FRIDAY OF EVERY WEEK, IN THE WEEK THAT THEY ARE COVERED.Every week students will write a summary of the facts of the case, a digest of the court’s decision or holding that explains theirrationale,and a brief discussionon the significance of the case to planning.Each studentshall share their opinions about the cases (these can be very brief –just a sentence or two is fine. There are several cases each week to discuss (sometimes as many as 7). Every case discussion is worth one point. Students should focus on the significance of the case for planning –not simply the facts of the case. For example, a student may write, “The case Haines v. City of Phoenixunderscores the importance of comprehensive planning in creating zoning regulations. However, courts have found that a comprehensive plan may not look the same everywhere, and some people may disagree with the format of the comprehensive plan. However, it is up tothe City to decide what constitutes a comprehensive plan. I agree that it is very important for a zoning ordinance to follow a comprehensive plan. However, I do not agree that the contents of a comprehensive plan are flexible. I think that every comprehensive plan should have some standard elements, including land use and transportation.” Use subtitle to separate each case analysis and don’t forget brief discussion on the significance of the case to planning. Such as agree or disagree. For example, you can say, “the Bove case helped me to better understand the difference between a nuisance and a taking” or “I think it is unfair that Mrs. Bove lost the case because the area was not zoned when she moved there” or “can somebody please explain the difference between a private and public nuisance, as used in this caseagn.” need have a personal opinion
