Research Question: ‘To what extent should climate
change migration, be protected under international
law?’
Abstract
It has become evident that climate change is one of the more important international issues
in recent years. Scientists have discussed the challenges of high levels of CO2 since 18961
,
however legal consideration for climate change was delayed until approximately 19972 when
the Kyoto Protocol3 was adopted, over a hundred years later. This history can indicate the
disparity between legislature and scientific research, making it clear that little cohesion has
occurred. That being said, the current acceptance of preventative measures into legislation
recognises the drastic implications which environmental damage has done to ecology,
however, there still remains silence on issues surrounding the global population from a
humanitarian approach. Although preventative measures have recently been enacted to try
and reduce the irreversible effects of climate change, it has become widely viewed that
natural disasters will still be in occurrence and the increase of migration will be inevitable.
As it stands 5.1 million people were displaced due to natural disasters in 20194
. This
number is rapidly increasing, and despite prevention being an end goal, may not protect
those still affected, leaving millions displaced. That being said, although most nations have
accepted climate change legislation into their jurisdictions, not much consideration has gone
into understanding the impact global warming can have at an international level.
